Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TrendVentures UG (haftungsbeschränkt) ("TrendVentures," "we," "us," or "our"), a limited liability company registered under German law.

By downloading, installing, accessing, or using any of our mobile applications or visiting our website at trendventures.de, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately discontinue use of our services.

These Terms apply to all of our applications collectively and individually, unless a specific application provides supplemental terms, in which case those supplemental terms also apply and, in the event of conflict, shall prevail with respect to that application.

You must be at least 13 years of age to use our services. By using our services, you represent and warrant that you meet this minimum age requirement. Certain features or applications may have higher minimum age requirements, as specified within those applications.

TrendVentures UG develops, publishes, and maintains the following applications on the Apple App Store:

• AURA AI: Texting Assistant

  An AI-powered writing companion that helps users craft compelling text messages, replies, captions, and social media content. AURA AI leverages large language model technology to generate, rewrite, and enhance written communication in real time.

• SaveMate

  A personal finance and savings management application designed to help users set saving goals, track expenses, monitor budgets, and develop healthy financial habits through smart notifications and visual progress tracking.

• Holy AI

  A spiritually-focused AI companion app offering daily devotionals, prayer guidance, scripture exploration, and faith-based conversation powered by artificial intelligence. Holy AI is designed for users seeking spiritual growth and reflection.

• AbsUp

  A fitness and workout application specializing in core strength training. AbsUp provides personalized workout plans, guided exercise sessions, progress tracking, and motivational content to help users achieve their fitness goals.

• Zappy AI

  A fast-response AI assistant designed for quick answers, content generation, and productivity tasks. Zappy AI prioritizes speed and simplicity, making it ideal for on-the-go users who need instant AI-powered support.

• Impact AI

  A professional AI tool focused on content creation, business communication, and marketing copy generation. Impact AI is built for creators, entrepreneurs, and business professionals who need high-quality AI-generated output at scale.

We reserve the right to add new applications to our portfolio, modify existing applications, or discontinue any application at any time. These Terms automatically apply to any future applications we release unless otherwise stated.

Certain features of our applications require you to create a user account. When creating an account, you agree to:

• —Provide accurate, current, and complete information during registration
• —Maintain and promptly update your account information to keep it accurate and complete
• —Maintain the confidentiality of your password and account credentials
• —Accept responsibility for all activities that occur under your account
• —Notify us immediately upon becoming aware of any unauthorized use of your account
• —Not share your account credentials with any third party
• —Not create multiple accounts for the purpose of circumventing restrictions or bans

We reserve the right to suspend or terminate accounts that violate these Terms, that have been inactive for an extended period, or that we believe have been compromised. We are not liable for any loss or damage arising from unauthorized use of your account.

You may delete your account at any time through the account settings within the respective application or by contacting our support team. Account deletion may result in the permanent loss of data, content, and any remaining subscription benefits.

4.1 Subscription Plans

Many of our applications offer optional premium features through subscription plans ("Subscriptions"). Subscriptions are processed exclusively through Apple's App Store using Apple's In-App Purchase system. By purchasing a Subscription, you agree to Apple's payment terms and policies in addition to these Terms.

4.2 Billing & Renewal

Subscription fees are charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew at the end of each billing period (weekly, monthly, or annually, depending on the selected plan) unless cancelled at least 24 hours before the end of the current period. The renewal fee will be charged within 24 hours before the end of the current period.

4.3 Free Trials

Some of our applications offer a free trial period. If you do not cancel before the free trial ends, you will be automatically charged for the Subscription. Only one free trial is permitted per Apple ID per application.

4.4 Cancellation

You may cancel your Subscription at any time through your Apple ID account settings or directly via the App Store. Cancellation takes effect at the end of the current billing period, and you will continue to have access to premium features until that date. We do not offer partial refunds for unused portions of a subscription period.

4.5 Refunds

All refund requests must be directed to Apple, as TrendVentures UG does not process payments directly. You may request a refund through Apple's standard refund process at reportaproblem.apple.com. TrendVentures UG has no control over Apple's refund decisions.

4.6 Price Changes

We reserve the right to change Subscription prices at any time. Price changes will be communicated with reasonable notice. Your continued use of the Subscription after a price change constitutes your acceptance of the new price.

Several of our applications (AURA AI, Holy AI, Zappy AI, and Impact AI) incorporate artificial intelligence and machine learning technologies. By using these AI-powered features, you acknowledge and agree to the following:

5.1 Nature of AI Output

AI-generated content is produced by automated systems and may contain errors, inaccuracies, or content that is incomplete, biased, or inappropriate. AI output does not constitute professional advice — including but not limited to medical, legal, financial, psychological, or spiritual advice — and should not be relied upon as such.

5.2 User Responsibility

You are solely responsible for how you use, share, or act upon AI-generated content. TrendVentures UG expressly disclaims all liability for any consequences arising from your reliance on AI-generated output.

5.3 Input Data

When you submit prompts, questions, or other inputs to our AI features, you grant us a non-exclusive, worldwide, royalty-free license to process that input for the purpose of providing the service. You must not submit inputs that contain personal data of third parties without their consent, confidential business information, or content that violates these Terms.

5.4 Content Filtering

Our AI systems are designed to refuse or filter harmful, illegal, or offensive content requests. Attempting to circumvent content filters — through prompt injection, jailbreaking, or other methods — constitutes a material breach of these Terms and may result in immediate account termination.

Some of our applications allow you to create, store, or share content ("User Content"). You retain all ownership rights to your User Content. By submitting User Content, you grant TrendVentures UG a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, and display your User Content solely to the extent necessary to provide the service.

You represent and warrant that:

• —You own or have the necessary rights to submit your User Content
• —Your User Content does not infringe the intellectual property rights of any third party
• —Your User Content does not violate any applicable law or regulation
• —Your User Content is accurate and not misleading

We reserve the right (but not the obligation) to review, remove, or disable access to any User Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable.

You agree not to use our applications or services to:

• —Violate any applicable local, national, or international laws or regulations
• —Infringe the intellectual property rights of TrendVentures UG or any third party
• —Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• —Impersonate any person or entity, or falsely represent your affiliation with a person or entity
• —Engage in any activity that could disable, overburden, or impair the proper functioning of our services
• —Attempt to gain unauthorized access to our systems, servers, or networks
• —Use automated tools (bots, scrapers, crawlers) to access our services without our prior written consent
• —Reverse engineer, decompile, or disassemble any part of our applications
• —Use our AI features to generate misinformation, spam, or harmful content at scale
• —Circumvent subscription paywalls or abuse free trial offers
• —Use our fitness or wellness applications (AbsUp, Holy AI) in ways that could endanger your health or safety
• —Use SaveMate to facilitate illegal financial activity or money laundering
• —Collect or harvest personal data of other users without their consent

Violation of these prohibitions may result in immediate termination of your account and access to all TrendVentures applications, and may expose you to civil or criminal liability.

All intellectual property rights in our applications, including but not limited to software code, user interfaces, graphics, logos, icons, text, audio, video, and the "look and feel" of our applications, are the exclusive property of TrendVentures UG or our licensors and are protected by applicable intellectual property laws, including German copyright law (Urhebergesetz) and international treaties.

We grant you a limited, non-exclusive, non-transferable, revocable license to use our applications for your personal, non-commercial purposes, subject to these Terms. This license does not include the right to:

• —Sublicense, sell, resell, or commercially exploit any part of our applications
• —Copy or duplicate our applications or any portion thereof
• —Use our trademarks, logos, or branding without our prior written consent
• —Create derivative works based on our applications
• —Remove or alter any copyright, trademark, or proprietary notices

The names "TrendVentures," "AURA AI," "SaveMate," "Holy AI," "AbsUp," "Zappy AI," and "Impact AI" are trademarks of TrendVentures UG. Unauthorized use of these marks is strictly prohibited.

Our applications may integrate with or link to third-party services, APIs, and platforms. These include, without limitation:

• —Apple App Store and Apple's payment infrastructure
• —AI model providers (e.g., OpenAI, Anthropic, or similar)
• —Analytics and crash reporting tools
• —Cloud infrastructure and storage providers
• —RevenueCat for subscription management

We are not responsible for the practices, content, or availability of third-party services. Your use of third-party services is governed by their respective terms of service and privacy policies. We encourage you to review those policies carefully.

OUR APPLICATIONS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, TRENDVENTURES UG DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• —WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• —WARRANTIES THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• —WARRANTIES THAT DEFECTS WILL BE CORRECTED
• —WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF AI-GENERATED CONTENT
• —WARRANTIES THAT OUR FITNESS APP (ABSUP) WILL PRODUCE SPECIFIC HEALTH OR PHYSICAL RESULTS
• —WARRANTIES REGARDING THE SUITABILITY OF HOLY AI'S CONTENT FOR ANY PARTICULAR RELIGIOUS DENOMINATION OR BELIEF SYSTEM
• —WARRANTIES THAT SAVEMATE WILL RESULT IN ANY FINANCIAL IMPROVEMENT

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable German law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRENDVENTURES UG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

• —Loss of profits, revenue, data, or business opportunities
• —Personal injury or property damage resulting from use of AbsUp or any fitness feature
• —Decisions made based on AI-generated content from AURA AI, Zappy AI, Impact AI, or Holy AI
• —Financial decisions influenced by SaveMate's recommendations or tracking
• —Unauthorized access to or alteration of your transmissions or data
• —Interruption or cessation of service

In any case, our aggregate liability to you for all claims arising out of or relating to these Terms or our services shall not exceed the greater of (a) the total amount you paid to us in the twelve months preceding the claim, or (b) fifty euros (€50).

This limitation of liability applies regardless of the legal theory on which the claim is based (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless TrendVentures UG and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• —Your violation of these Terms
• —Your use of our applications in a manner not authorized by these Terms
• —Your User Content
• —Your violation of any applicable law or the rights of any third party
• —Any misuse of AI-generated content produced by our applications

Our applications are distributed via the Apple App Store. As an end user, you must comply with Apple's App Store Terms of Service. The following additional terms apply with respect to our Apple App Store applications:

• —These Terms are concluded between you and TrendVentures UG, not with Apple, Inc. TrendVentures UG, not Apple, is solely responsible for our applications and their content
• —Apple has no obligation to furnish any maintenance or support services with respect to our applications
• —In the event of any third-party claim that our application infringes intellectual property rights, TrendVentures UG, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim
• —Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary
• —Your use of our applications must comply with the Usage Rules set forth in Apple's App Store Terms of Service

These Terms are effective until terminated. We may terminate or suspend your access to our applications and services at any time, with or without cause, with or without notice, if we believe you have violated these Terms.

You may terminate these Terms at any time by deleting our applications from your device and discontinuing use of our services. If you have an active subscription, termination of these Terms does not automatically cancel your subscription — you must cancel separately through your Apple ID settings.

Upon termination, your right to use our applications ceases immediately. Provisions of these Terms which by their nature should survive termination — including intellectual property rights, disclaimers, limitation of liability, and governing law — shall survive termination.

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Effective date" at the top of this page, by sending a push notification through our applications, or by another reasonable means. It is your responsibility to review these Terms periodically.

Your continued use of our applications after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must discontinue use of our services.

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

Any disputes arising out of or in connection with these Terms or our applications shall be submitted to the exclusive jurisdiction of the competent courts in Germany. If you are a consumer resident in the European Union, you may also bring proceedings in the courts of the EU member state where you are habitually resident.

We are not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration board. The European Commission provides an online dispute resolution (ODR) platform accessible at https://ec.europa.eu/consumers/odr/.

In the event that any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects the intent of the original provision.
